In no event shall Property.Com, LLC, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Services.
  1. Limitation of Liability/Exclusive Remedy
    The aggregate liability of Property.Com, LLC for all claims arising out of or related to the use of, or any inability to use any portion of the Services or otherwise under these Terms of Use, whether in contract, tort, or otherwise, is limited to the greater of: (1) the amount you have paid to Property.Com, LLC for access to and use of the Services in the 12 months prior to the event or circumstance giving rise to such claim; or (2) $100.
  1. Governing Law and Jurisdiction

This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

    Class Action Waiver: You and Property.Com, LLC agree that any arbitration shall be conducted in your individual capacities only and not as a class action or other representative action. You and Property.Com, LLC expressly waive your right to file a class action or seek relief on a class basis. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason or that an arbitration can proceed on a class basis, then the arbitration provision set forth above shall be deemed null and void in its entirety and the parties shall be deemed to have not agreed to arbitrate disputes.

    Opt-Out Procedure: You may opt out of this agreement to arbitrate by sending a written opt-out notice to info@property.com within 30 days of the first date you access or use the Services. The opt-out notice must include your full name, address, and a clear statement that you do not wish to resolve disputes with Property.Com, LLC through arbitration. If you opt out of arbitration, all other parts of these Terms of Use will continue to apply to you. Opting out of this arbitration provision has no effect on any previous, other, or future arbitration agreements that you may have with us.

    Exception – Small Claims Court Claims: Notwithstanding the parties’ agreement to resolve all disputes through arbitration, either party may seek relief in a small claims court for disputes or claims within the scope of that court’s jurisdiction.

    By using the Services provided by Property.Com, LLC, you expressly consent to receiving electronic communications from us. These communications may include notices about your account, updates to our Services, promotional information, and other information related to real estate transactions or services offered through Property.Com. We may communicate with you via email, in-app messages, text messages, or through other electronic means. Your consent to receive electronic communications is a condition of your use of our Services. You may opt-out of receiving certain types of communications as provided in our Privacy Policy, but opting out may affect the functionality of the Services. Please note that even if you opt out of receiving marketing messages, we may still send you non-promotional communications, such as those about your account, our ongoing business relations, or updates to our Terms of Use or Privacy Policy.

Apple has no obligation whatsoever to furnish any maintenance and support services with respect to our Services. In the event of any failure of the Services to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the relevant app to you (if applicable).
